1. Acceptance of Terms

By accessing or using SocialPulses (the "Service"), you agree to these Terms. If you do not agree, do not use the Service. You must be at least 16 years old. By using on behalf of an organization, you represent authority to bind it.

2. Account Registration

You must provide accurate information. You are responsible for your password and all account activity. Notify us via our contact form.

• No multiple accounts for abusive purposes.
• No sharing credentials with unauthorized users.
• You are responsible for all content published through your account.

3. Acceptable Use

You agree to use the Service lawfully. Prohibited activities include:

• Illegal Activity: Any violation of applicable laws.
• Spam: Unsolicited messages or automated content violating platform policies.
• Abuse: Harassing or harming others.
• Security Violations: Bypassing security or disrupting the Service.
• API Abuse: Excessive requests, reverse engineering.
• Content Restrictions: Hateful, violent, discriminatory, or infringing content.

4. Payment and Billing

• Pricing: Available at socialpulses.io/pricing. Subject to change with 30 days notice.
• Taxes: You are responsible for applicable taxes.
• Payment Method: Processed via Stripe. You authorize recurring charges.
• Free Trial: 14-day trial. Cancel before trial ends to avoid charges.
• Late Payment: Account suspended after 7 days, terminated after 30 days.

5. Cancellation and Refunds

• Cancel anytime from account settings. Active until end of billing period.
• No prorated refunds for partial months.
• Annual plans: prorated refund within 14 days of renewal.
• Data export available before cancellation. Data deleted after 90 days.

6. Intellectual Property

6.1 Our IP

The Service, including code, design, logos, trademarks, and AI models, is owned by SocialPulses Inc. You may not copy, modify, distribute, or reverse engineer.

6.2 Your IP

You retain ownership of your content. You grant us a limited license to process your content solely to provide the Service.

6.3 AI-Generated Content

AI-generated content is owned by you. We make no guarantees of uniqueness. You are responsible for reviewing before publishing.

7. Limitation of Liability

To the maximum extent permitted by law, SocialPulses shall not be liable for indirect, incidental, or consequential damages; loss of profits or data; or damages exceeding fees paid in the 12 months preceding the claim.

8. Termination

We may suspend or terminate accounts for Terms violations. Upon termination, access ceases immediately. Data deleted after 90 days. Prepaid fees not refunded. Sections 6, 7, 10, and 12 survive.

9. Third-Party Services

We integrate with third-party platforms. We are not responsible for their availability, security, or actions.

10. Indemnification

You agree to indemnify SocialPulses from claims arising from your use of the Service, your content, or violation of third-party rights.

11. Changes to Terms

We may modify Terms with 30 days notice for material changes. Continued use constitutes acceptance.

11.5 Return & Refund Policy

SocialPulses offers a 14-day free trial for all new users. No payment information is required during the trial period.

Paid subscriptions:

• Monthly plans may be cancelled at any time. No prorated refunds for partial months.
• Annual plans include a 14-day refund window from the date of renewal.
• All refunds are processed within 5-10 business days to the original payment method.

To request a refund, contact us at support@socialpulses.io with your account email and reason for cancellation.

12. Governing Law

Governed by California law. Disputes resolved in San Francisco County courts. Informal dispute resolution attempted before litigation.
